DMCA Policy

ActivelyLicensed.com is committed to upholding the intellectual property rights of others. We expect our users and content contributors, particularly those operating within the New Jersey real estate sector, to respect these rights as well. This DMCA Policy explains how to report copyright infringement to us and how to file a counter-notification if you believe your content was removed in error.

Reporting Copyright Infringement (DMCA Takedown Notice)

If you believe content on ActivelyLicensed.com infringes your copyright, you may send us a DMCA takedown notice. To be effective, your notice must include the following information. Missing elements can delay our response to your request.

  • A physical or electronic signature of a person authorized to act on behalf of the copyright owner.
  • Identification of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works at a single online site are covered by a single notification, a representative list of such works at that site.
  • Identification of the material claimed to be infringing or to be the subject of infringing activity and that is to be removed or access disabled. Provide information reasonably sufficient to permit us to locate the material.
  • Information reasonably sufficient to permit us to contact the complaining party, such as an address, telephone number, and, if available, an electronic mail address.
  • A statement that the complaining party has a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  • A statement that the information in the notification is accurate, and under penalty of perjury, that the complaining party is authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

Upon receiving a valid and complete notice, we will remove or disable access to the infringing material. We will also inform the user who posted the content of the takedown.

Counter-Notification Process

If you believe your content was removed by mistake or misidentification, you may submit a counter-notification. This applies if you are the owner of the content or authorized to use it. Your counter-notice must include specific details.

  • Your physical or electronic signature.
  • Identification of the material that was removed or to which access has been disabled, and the location where the material appeared before its removal or access was disabled.
  • A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.
  • Your name, address, telephone number, and email address.
  • A statement that you consent to the jurisdiction of the federal district court for the judicial district in which your address is located (or if you are outside the U.S., any judicial district in which ActivelyLicensed.com may be found), and that you will accept service of process from the person who provided the original DMCA notification or an agent of such person.

Please send counter-notifications to the same Designated Copyright Agent email address: [email protected]. We will forward your counter-notification to the original complaining party. If the complaining party does not initiate a court action within 10-14 business days, we may restore the removed content.

Repeat Infringer Policy

ActivelyLicensed.com has a policy of terminating user accounts of individuals who are repeat infringers of copyright. This policy applies to any content published on our platform, including articles and discussions related to New Jersey real estate practices. We reserve the right to remove content and terminate accounts at our discretion for copyright violations.
